2. Conditions Applicable.
2.1 By placing an order with Cotswold Giftware, the buyer agrees to be bound by these terms. If you do not accept these terms, you may not use this site or access or display any of the information made available to you at this site.
2.2 Cotswold Giftware shall sell and the buyer shall purchase the products in accordance with any written, electronic or verbal order of the buyer which is accepted by Cotswold Giftware, subject in any case to these conditions, which shall govern the contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such order is made or is purported to be made, by the buyer.
2.3 Any variation of these conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by Cotswold Giftware, acting by its Proprietor or some other person authorised in writing by him.
2.4 Any typographical or clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by Cotswold Giftware shall be subject to correction without any liability on the part of Cotswold Giftware
2.5 If any provision of these conditions is adjudged invalid or unenforceable in whole or in part the validity of the other provisions of these conditions and the remainder of those provisions in question shall not be affected.
Your statutory rights are not affected
2.6 All sizes and measurements and weights are approximate but we do try to make sure that they are as accurate as possible. On the rare occasion that there is an error, we will advise you about it as soon as possible.
2.7 Pictures are for illustrative purpose only, and may not exactly match the product itself.
2.8 Colours may vary slightly to those illustrated.
2.9 Sometimes our product specifications may change, in which case we will do our best to offer you a substitute of the same or better quality at the same price.3. Price
3.1 Prices are correct at time of publication.
3.2 All prices include VAT at the standard rate (20%).
3.3 Cotswold Giftware reserve the right to change any advertised prices at any time.
3.4 Errors and omissions are excepted.
3.5 All prices are in Great Britain Pounds Sterling.
We do not offer a facility to refund VAT for items that are exported outside of the UK.4. Offer and acceptance
4.1 A binding contract is formed between you and Cotswold Giftware when you receive confirmation from us by e-mail, telephone or other agreed means that your order has been accepted.
4.2 Other than where the Buyer acts as a Consumer Cotswold Giftware shall be deemed to have accepted the Products 7 working days of delivery to the Buyer.
4.3 After acceptance the Buyer shall not be entitled to reject Products which are not in accordance with the contract.
4.4 Where the Buyer accepted any Products then Cotswold Giftware shall have no liability whatever to the Buyer in respect of those Products.
4.5 To order goods you must be least 18 years of age.
5. Supply of goods.
5.1 The Buyer is solely responsible for ensuring that the Products are suitable and fit for the purpose.
5.2 Cotswold Giftware reserves the right to refuse the supply of goods at its discretion.
6.1 All orders must be paid for in full at the time they are placed.
6.2 Cotswold Giftware accept online payment via PayPal. No charge is made to a consumer for credit card payments.
7.1 All goods are offered subject to availability. Were goods are found to be unavailable or discontinued, Cotswold Giftware will offer a similar substitute if available, subject to your agreement.
7.2 Cotswold Giftware may make any changes in the specification of the Products which do not materially affect their quality or performance required to conform with any applicable statutory requirements where the Products are supplied to Cotswold Giftware specification.
7.3 If a suitable substitute is not available, the transaction for that item will be void and any payment will be returned.
7.4 In the event of any product being unavailable, Cotswold Giftware shall be relieved of any liability in connection with all such contracts or orders. In no case shall the company be bound to obtain or deliver Products from any other sources than those contemplated in the order.
7.5 Cotswold Giftware will not be held responsible for any costs incurred due to items being delayed or unavailable.
8.1 Neither party shall be liable for any default due to any act of God, war, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply.
8.2 Cotswold Giftware shall be entitled to delay or cancel delivery or to reduce the amount delivered if it is prevented from or hindered in or delayed in manufacturing, obtaining or delivering the products by normal routes or means of delivery through circumstances beyond its control.
9 Cancellation of orders.
9.1 Under the Distance Selling Regulations you have a right to cancel your order for any item purchased on this website at any time before the goods are dispatched, or within 7 days of receiving your goods and for a full refund excluding cost of return postage providing you take reasonable care of the goods whilst they are in your possession. This does not affect your statutory rights as a consumer.
9.2 We reserve the right to refuse the return of any items after 7 days following delivery.
9.3 We will refund your payment within 28 days of the goods being returned.
9.4 If you would like to cancel your order, please email us at the address provided.
9.5 Should you wish to cancel your contract after the goods have been dispatched to you or your customer, you will be responsible for returning the goods to Cotswold Giftware Returns address within 10 days, at your own cost, unless the goods are faulty or misdescribed.
10.1 Delivery will be made to the address specified through our checkout when you complete your order.
10.2 Should you wish to change the delivery address after goods have been dispatched, we will require you to cover the delivery charges for the redirection (please note re-direction is only available for goods despatched via courier). The charges will be the same as the original delivery charge. Please be aware that the redirection approval is subject to your order status.
10.3 Orders are aimed to be delivered within 3-5 working days after dispatch.
10.4 If the delivery of the order will be refused, or it fails due to you cancelling the contract, Cotswold Giftware will refund you within 30 days for any sum that has been paid by you with respect to the goods. By exercising your right to cancel, you are required to return the goods, at your own cost, to Cotswold Giftware returns Address. If you fail to return the goods within 14 days, we reserve the right to charge you for any costs incurred during retrieving the goods from you.
10.5 We make every effort to ensure goods are delivered within five working days of acceptance of your order. However, Cotswold Giftware will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this event, we will inform you of any delays as soon as possible.
10.6 For courier deliveries, please ensure you provide a delivery address, where someone will be available to receive the delivery between 7.30am and 5.30pm, Monday to Friday. If the couriers are unable to complete a delivery due to nobody being present, a calling card will be left asking you to contact them directly to arrange a re-delivery. If you do not contact the couriers within 2 days of receiving this card, the goods will be returned to our Dispatch Depot and a re-delivery charge may be applicable to your order.
11 PayPal messages
11.1 Please do not send messages via PayPal relating to orders as we do not receive these messages, we will not be held responsible for failing to make any changes requested in a PayPal message.
12.1 All products supplied by Cotswold Giftware have a 6 month manufacturer’s warranty period from the date the goods were delivered unless otherwise stated. This warranty does not affect your statutory rights as a consumer.
12.2 Please note, the warranty does not cover you for any defects in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than in accordance with its intended use. Consumable items, (e.g batteries) are covered for physical defects in accordance with the terms above. Consumable items, (e.g batteries) are not covered for replacement during ‘normal’ use.
13 Faulty Item(s).
13.1 If you receive goods that are faulty or incomplete on arrival, you must notify us within 72 hours of receipt of the item in writing (by post, by e-mail or by using the Contact Us page on the website).
13.2 We do not cover faults caused by accident, neglect, misuse or normal wear and tear.
For items to the value of £18 sale price, excluding silver jewellery items, we request photographic evidence of any visible faults instead of a return.
13.3 We will check products returned as faulty. If the fault is verified, we will replace the item within 5 working days at no additional cost to you and you will be reimbursed for any reasonable carriage costs incurred by the return. If for any reason, we are unable to replace the item (for example, due to discontinuation of a product), you will be offered a choice of a substitute alternative product or a refund for the faulty item.
13.4 For items over £18 sale price, please contact us via our email describing the type and extent of the fault and we will advise you how to proceed.
13.5 Please do not place duplicate orders for replacement of damaged/faulty goods.
For heavy, courier delivered items of the value of over £18 sale price with visible fault (s) that we wish returned to us we can, upon request, despatch a replacement item and arrange a courier collection of the damaged item at the same time (*please note this is only available in the circumstance that the recipient will be available at the address to pass the faulty goods to the courier)
13.6 If the goods you have returned are found not to be faulty, you will be notified in writing. You will receive a refund or an offer of a replacement for the original goods, however, we will ask you to cover the delivery charges, and no return delivery charges will be refunded.
14 Item(s) Damaged on Arrival.
14.1 In the unlikely event of you receiving a damaged product, you should notify us in writing by email within 48 hours of receipt of the goods. For items to the value of £18 sale price, we request photographic evidence of any visible damage instead of a return.
14.2 For items over £18 sale price, please contact us via email describing the type and extent of the damage and we will advise you how to proceed.
14.3 For heavy, courier delivered items of the value of over £18 sale price with visible damage that we wish returned to us we can, upon request, dispatch a replacement item and arrange a courier collection of the damaged item at the same time (*please note this is only available in the circumstance that the recipient will be available at the address to pass the faulty goods to the courier)
14.4 In the event the damaged goods are to be returned to us by the recipient. Once we have received the goods at our Dispatch Depot, we will examine the goods for the damage. If the damage is verified, we will replace the item within 3 working days at no additional cost to you and you will be reimbursed for any reasonable carriage charge incurred by the return.
14.5 If the goods you have returned are found not damaged, you will be notified in writing. You will receive a refund or an offer of a replacement for the original goods, however, we will ask you to cover the delivery charges, and no return delivery charges will be refunded.
15 Wrong Item(s) Delivered.
15.1 If, by mistake, we supply you with an incorrect item, you must notify us within 30 days. If your customer wishes to return the item for replacement it must be in lines with our Returns Procedure. Depending on the value of the item the customer is free to keep the item if they are happy with it, and any refund for a difference in value will be issued, conversely, if the item is of higher value than the original item paid for a PayPal / Stripe request will be sent for the difference.
15.2 If the projected reasonable carriage costs for an item to be returned exceeds the value of the item (it’s original sale price as listed on the Cotswold Giftware website), we will ask for photographic evidence that the item is incorrect, the end customer is then free to dispose of the incorrect item in the manner most convenient to themselves.
15.3 The goods should be returned to us in line with our Returns Procedure. Once we have received the incorrect items at our Dispatch Depot or received proof of postage, the correct items will be shipped within 4 working days and you will be reimbursed for any reasonable carriage charge incurred by the return.
15.4 In the event of an item of over 2kg in weight we can arrange a courier collection at the same time as the correct item is delivered (this service is only available if there will be somebody present at the delivery address to accept the delivery and pass back the incorrect goods).
16 Item(s) Not Required.
16.1 If you wish to return an unwanted item, you must notify us in writing (either by post, by e-mail or by using the Contact Us page on the website) within 14 days of receipt of the item. A refund will be credited back to your original method of payment within 30 days of you notifying Cotswold Giftware of the cancellation.
16.2 The item should be returned to us in line with our returns instructions within 28 days of you notifying us. You will be responsible for returning the goods at your own cost, and they should be returned in their original packaging and ‘as new’.
16.3 This condition does not apply to perishable (those items supplied with a printed Use By date) items, unless previously agreed in writing with Cotswold Giftware.
17 Extra Item(s) Delivered.
17.1 If, by mistake we supply you with extra items, you must notify us immediately, either in writing (by e-mail or by using the Contact Us page on the website) The item(s) should be returned to us in line with our Returns Procedure.
17.2 Once the goods have been returned to the Despatch Depot, you will be reimbursed for any reasonable carriage charge incurred by the return.
17.3 If you do not inform us of receipt of extra items and you are found in possession of goods that you have not paid for, you will be charged for the goods in full.
18 Non-Delivery of Item(s).
18.1 Please allow 5 working days from dispatch for the delivery of ordered items. If the items are still not delivered after this time, please contact Cotswold Giftware via email. Please provide us with the original order number as reference.
18.2 We will then investigate the non-delivery with the relevant delivery service provider used for the order and offer you a replacement order to be sent out or a full refund for the undelivered goods.
19 Returns Procedure.
19.1 Please note, as stated above, in the event of an item arriving damaged contact must be made to ourselves in writing and we will advise whether a return is necessary. We request photographic evidence of all damages wherever possible, rather than a return.
19.2 Items should be returned in their original packaging and ‘as new’ to the Despatch Depot:
19.3 Before returning any items, you must inform Cotswold Giftware of the reason for the return. Please quote your original order number (starting with AW) on all returns and correspondence.
19.4 In the event of an item returned to Cotswold Giftware not arriving, you will be asked to provide tracking details (where applicable) or a receipt of proof of postage.
19.5 We advise that customers return items of high value (£18 or more) a return signed for second class.
20 Title & Risk.
20.1 Risk of damage to or loss of the Products shall pass to the Buyer upon delivery.
20.2 Notwithstanding any other provision herein title in the Products shall not pass to the Buyer until Cotswold Giftware has received in cash or clear funds payment in full.
21 Privacy & Security.
21.1 All personal details that you give us are securely stored. We do not supply or sell customers details to any outside organisation. We will endeavour to take all reasonable care, in so far as it is possible to do so, to keep all details of your order and payment secure, but, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering.
21.2 All credit and debit card details are encrypted using 128-bit encryption and sent over a secure server. They are not decrypted after they reach our computer. They are not held in clear text on any website.
22 Use of our site.
22.1 To the fullest extent permitted at law, Cotswold Giftware is providing this site and its contents on an “as is” basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this website or the information, content, prices, materials or products included in this site including, without limitation, warranties of merchantability, satisfactory quality and fitness for a particular purpose.
22.2 Except as specifically stated on this site, to the fullest extent permitted at law, neither Cotswold Giftware nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of it or the information, content, materials or products included on it. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. For the avoidance of doubt, Cotswold Giftware does not limit its liability for death or personal injury to the extent only that it arises as a result of the negligence of Cotswold Giftware its affiliates, directors, employees or other representatives.
23 Governing law and jurisdiction.
23.1 This contract is subject to the law of England and Wales. All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.
24.1 No statement, description, warranty condition or recommendation contained in any catalogue, price list or advertisement or communication or made verbally by any of the Agents or Employees of Cotswold Giftware shall be construed to enlarge, vary or override in any way thereof any of these conditions.
25 Consequential Loss.
25.1 Cotswold Giftware shall not be liable for any costs claims damages or expenses arising out of any tortuous act or omission or any breach of Contract or statutory duty calculated by reference to profits income or accrual or loss of such profits income production or accruals or by reference to accrual of such costs claims damages or expenses on a time basis, to the fullest extent of the law. Please do not book installers for any items until you have received and checked your order in full.
26.1 Cotswold Giftware do not accept any liability for any website not under our control, which may act as a portal to our site or be connected by a link with our site or that we connect by a link to.
27.1 Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control and the party shall be entitled to a reasonable extension of its obligations.
27.2 These terms and conditions are subject to change at any time without prior notice to you.
